Party Rental Agreement, Liability Waiver, Damage Fee Contract

  • TERMS & CONDITIONS RESERVING EQUIPMENT:  Equipment will be reserved upon the deposit of 25%, this deposit is NON-REFUNDABLE within 7 days prior to event and will be paid cash, credit card,  or Venmo.  This equipment cannot be sub-rented. Within 7 business days of the scheduled event, items cannot be cancelled. Cancelled items within these 7 days will be charged to the renter at full rental cost unless rescheduled to another date. 

  • MISSING OR DAMAGED ITEMS: Callahan Entertainment will pick up the items on a specified date and at a time agreed upon at delivery. If all items are not present, items not returned to Callahan Entertainment within 2 business days after the event are considered missing. Missing or damaged/excessively dirty items will be charged to the client at replacement/cleaning cost. A detailed invoice on these items will be provided to the client.

  • FINAL PAYMENT: Final payment is due on delivery, and will be made by cash, Credit, or Venmo.

  • DELIVERY & SET UP: Callahan Entertainment will strive to accommodate client delivery requests; however, delays and changes in the schedule are sometimes unavoidable. We try to communicate any scheduling changes as they occur. All items will be delivered and picked up at a designated location. The client must be available to count all items upon delivery and pickup; otherwise, Callahan Entertainment counts will be considered to be accurate. If any tent is ordered, the tent and liners for the tent will be properly set-up and secured in a designated area by the delivery personnel.  There is no warranty that rented items are free of defects. The renter takes full responsibility of proper set up of tables and chairs to ensure proper leg locking for full stability. It is the responsibility of the renter to communicate to Callahan Entertainment of any underground wiring, pipes, sewage systems, or anything else that could interfere with the tent stakes. It is suggested that the renter calls 811 to have their utility company come out and mark any underground lines prior to delivery of the rental items. Stakes are driven between 1-3 feet under the ground. If any underground systems are not communicated to Callahan Entertainment personnel or incorrect information is given, Callahan Entertainment will not be responsible for any underground damage.

  • CLEAN UP & PREPERATION FOR PICKUP: All floral arrangements, center pieces, trash, and decorations of any kind should be removed from the tent(s) or other rental equipment before scheduled pickup time. There will be an additional charge for any items that have to be removed (per Callahan Entertainment personnel’s discretion). Linens should be food and particle free and shaken out before being placed in laundry bags. Linens that are returned with burns, wax, holes, tears, permanently stained, wet, or damp with mildew, or otherwise unusable will be charged to the client at replacement cost. A detailed invoice on these items will be provided to the client. Be sure to notify your caterer of these conditions. We do not offer party clean up services.

  • WEATHER: Tents are temporary structures designed to handle most normal weather conditions; however, there may be situations that become unsafe such as high winds or lightning. Evacuation of tents is recommended in these or other unsafe conditions. The renter is responsible for posting and maintaining in a public place on or near the tent an OSHA-compliant evacuation plan. Callahan Entertainment will not be held responsible for any damage made to the rental items or by the rental items in the case of a severe weather emergency.

  • DAMAGE AND LIABILITY: The renter agrees that Callahan Entertainment holds no liability for any damage or injury caused by the use of rental items to the renter or any third party. The renter assumes all risk of personal property damage or personal injury and if any accident involving Callahan Entertainment items has occurred while it is in the renter’s possession, the renter shall make Callahan Entertainment aware by written statement of details of occurrence of the event including a police report and names and addresses of witnesses.

  • SUMMARY: RESPONSIBILITY OF THE EQUIPMENT REMAINS WITH THE CLIENT FROM THE TIME OF DELIVERY TO THE TIME OF PICKUP. Please be sure all equipment is secured when not in use and protected from weather. All collection fees, attorney fees, court costs, or any expense involved in the collections of rental charges or damaged items will be the clients’ responsibility. Be sure all equipment is returned according to these terms & conditions. The client is solely responsible for any additional charges incurred as a result of failure to meet these conditions.

  • CUSTOMER IS RESPONSIBLE FOR FOLDING THE CHAIRS AND TABLES AND PLACING IN STACKS SILIMIAR TO HOW THE ITEMS WERE DROPPED OFF.  IF THIS IS NOT DONE THERE WILL BE A $100 LABOR FEE CHARGED TO THE CREDIT CARD ON FILE

  • I HAVE READ AND AGREE TO THE ABOVE TERMS & CONDITIONS AND ACKNOWLEDGE RECIEPT. THIS CONTRACT IS VALID FOR ALL RENTALS PURCHASED BY THIS CLIENT, AND SUPERCEDEDS ALL PRIOR CONTRACTS.

Inflatable Rental Agreement

Rental Agreement, Liability Waiver, DAMAGE FEE CONTRACT (READ VERY CAREFULLY)

  • It is the responsibility of the person or organization hiring this inflatable equipment to ensure that all possible precautions are taken to avoid injury to people or damage to the Inflatable.Please ensure that the following Safety Instructions are followed:

  • . No food, drink or chewing gum on or around the Inflatable. This will avoid a choking risk and keep the unit clean. (Please note if the Inflatable is collected in a dirty condition, then the person hiring it will incur a cleaning charge). 

  • Shoes, glasses, sharp jewelry, and badges MUST be removed before using the inflatable to avoid injury to peoples using the equipment and harm to the Inflatable.

  • No face paints, party poppers, colored streamers or silly string to be used either on or near the Inflatable. (Please note these products will cause damage to the Inflatable that cannot be repaired)4. NO smoking on or around the Inflatable. 

  • NO barbeques around the Inflatable. 

  • Climbing, hanging, or sitting on walls is dangerous and must not be allowed. 

  • A responsible adult must always supervise the inflatable. 

  • Always ensure that the Inflatable is not overcrowded, and limit numbers according to the age and size of Children using it. Try to avoid large and small children from using it at the same time.

  • Ensure Children are not pushing, colliding, fighting or behaving in a manner likely to injure or cause distress to others.

  • No pets, toys or sharp instruments on the inflatable at any time.

  • Do not allow anyone to BOUNCE, SLIDE OR CLIMB OR INFLATABLE OR on the front safety step as this is dangerous.

  • Do not allow anyone to be on the inflatable equipment during inflation or deflation as this is DANGEROUS.

  • Please ensure that Children are not attempting somersaults and are clothed appropriately and that nothing can fall out of their pockets. 

  • In the event that the blower stops working, please ensure all users get off the inflatable immediately and calmly. Check your breaker(s) and make sure the blower tube or deflation tube has not come undone or something has not blown onto and is obstructing the blower. In the event that it overheats, or loses power, switch the blower off at the mains, then switch it back on again 1 or 2 minutes later, and it should restart. If it does not, inform us immediately at (315) 640-5604.15.

  • If wind is greater than 15MPH Please turn off/ unplug the inflatable. DO NOT USE until the wind is BELOW 15MPH. 16.

  • THE MOST IMPORTANT RULE: DO NOT let children play on the inflatable without Adult supervision. Adult supervision is necessary to enforce these rules for safe operation of the Inflatable.

  • Customer assumes all responsibility for injuries to persons or damages to property and agrees to release and hold Callahan Entertainment harmless for any and all claims, of whatsoever nature, arising out of use of the rental equipment while in his/her custody. In the event that the release and hold harmless as contained herein is held unenforceable for any reason, the customer hereby agrees to a limit on any damages claimed by Customer to the total paid to Callahan Entertaiment for the rental.

  • The customer agrees that company employee has the right to enter premises of customer at anytime to repossess any and all equipment.

  • The customer agrees to reimburse Callahan Entertainment. for all attorney fees, an amount not less than 100% of all sums due, court cost and expenses incurred by Callahan Entertainment. to enforce collection or to preserve or enforce rights under this contract.

  • Customer agrees not to loan, sublet, or otherwise depose of equipment or use it at any other location.
    6. Customer agrees to pay in full the replacement cost, including labor, for all damages to rental equipment.

  • If the inflatable equipment is lost, stolen, or damaged beyond repair the renter agrees to pay replacement costs for the equipment.

  • Customer is responsible for all users of rental equipment until unit is picked up. We will notify customer 48-72hrs of any damage/ additional fee once the unit is clean/ inspected. (Especially for Night Pickups when visibility is limited).

  • THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS EITHER EXPRESSED OR IMPLIED. The person(s) or organization renting this Equipment from Callahan Entertainment will be held responsible and liable for any and all damage or injury occurring for any reason whatsoever. I have read the above agreement and fully understand and accept the conditions as above. I am aware that while in my care I am fully responsible for the inflatable and will pay for any loss or damage that may occur.

  • The water needs to be turned off BEFORE the Inflatable is turned off.  For single day rentals please leave the inflatable plugged in and turned on until Callahan Entertainment arrives to pick up.  For overnight rentals please turn the water off first.  Drain the pool best you can by stepping on one side, then turn off the blower.  The next day turn on the blower and let it fully inflate. Fill the Pool halfway, then turn on the water to the slide.
